If your'e reference is to United States Citizens as oppossed to Americans (I assume you are American, being Canadian?), they are not looking at a "class action," but a civil tort if they suffered damages due to an act by another.
A class action requires far differebt criteria and is seldom used to correct a situation such as a single incident of food poisoning.
A class action would be a suit such as the one against Dow Corning (Silocone implants)
Before you "Canadians" start criticising others, try and get yoyur facts and nationalities correct.
