Frank--I really don't give a rat's arse about the buying and selling of property in JD and responded more from a point of view as a "real estate person".
"These problems are known" is NOT a disclosure statement. A disclosure statement signed by builder or seller is a legal obligation to "disclose 'problems' ". But I guess in your country you don't do things that way.
BTW--Frank you know me. When I stayed at Embassy Suites you showed me an apartment over at (name) where the shuttle bus goes.
