Default Lease Agreements

Hi,

This question is probably aimed more towards Fabio Guzman, but feel free to add your two cents from experience.

We have a property in the Naco area. After evicting the tenants (long, long long story) we cleaned up the property in the thought of putting up a building. At this time it is an empty lot.

We have someone who is interested in leasing it for commercial purposes. Having had problems with evicting tenants (which we may want to do down the road) what is the best way to deal with a lease? Are there standard leases???

The person that wants to lease, wants to build a portable structure, "mejores". How do we protect ourselves from making a claim against the property for any "improvements" which we would most likely want removed when we are ready to build.

Any and all comments are welcome..

Evicting a tenant with a good lawyer is always a problem in the DR. The laws are just too one-sided against the lessor.

As for the improvements, a standard clause in most leases states that any improvements (“mejoras”) made by the tenant will become the property of the owner at the end of the lease.

Thanks for your reply. We will make sure we have the clause for "mejoras". I guess when we're ready to evict we'll cross that bridge when we get to it.
