Question liquidation for gardener?

My gardener works since more than 2 years for us. Lately I haven't been very happy with his work, I started to get angry about my dead flowers and plants. Probably since he couldn't take me bitching about it, yesterday he told me, that he will not work for us anymore after Oct. 15 and quit.

So now I will pay him on Oct 15 his salary up to that day and 9.5/12 of his christmas bonus. Anything else I need to pay him by law? I checked the website of sectretario de trabajo, but do I have to pay liquidation/preaviso for a domestic employee who quit the job himself?

Forget the preaviso but by your own admission it was your bitching that caused him to quit.

Whether quaqualita pays or not is one thing, but she has no responsibility for his decision to quit if he couldn't take her bitching. If she wasn't satisfied with his work, she should have made this clear--and continued to do so if he didn't seem to be getting the message.

See the thread on Dominican work ethic. There are a lot of Dominicans who need to be bitched at.

I understand that if you quit your job, you are not entitled to any extra money as opposed to your prestaciones when you are fired.

A little amnesia can be a good thing sometimes, but not when posting here.

Seems to me there was just a little matter of his killing off the flora and fauna he was being paid to nurture? So what exactly was the poor b-----d (please read that without the word poor) doing to deserve getting a handout every week besides breathing?

There's plenty of jobs like that around down in Baldyland. Ask his Hipponess to pay and leave the folks who actually worked hard to earn their money like Quaqualita alone! She has every right to bitch. She's the one paying the bill! And I wouldn't give him anything beyond what was owed through the last day either.

Generally, I tend to try to overpay people working for me here.

The difference may only be an extra US$10-$20/week, but it means you spend much less time dealing with turnover and related hassles. My time is easily worth the difference.

thanks for all your replies, specially to XanaduRanch for your understanding.

2 years ago, I had a nice Hibiscus hedge, lots of colorful flowers and a green lawn - now nothing is left. Everything is brown, dead and dusty. I probably started to "bitch" way too late about the lousy job my gardener did.
I paid him 2000 Pesos/month for a part time job (20 hrs/week), I think that's a pretty good salary, since I hear that full time gardeners sometimes have to work for less.

I'm glad he quit himself, so at least I don't have to go through the hassle and maybe problems to fire him. So, I will pay him tomorrow his salary for the half month and the part of the christmas bonus. Vacation he took allready this year, so there is nothing else I have to pay legally, right?

Still would like to know, what exactly the law says, I can't find any references regarding 'Domesticos' online. If Mr. Guzman is around, I really would appreciate to know, what his opinion is.

Fabio posted recently that he would be on vacation until end of October, so you probably won't get a response from him until then. Sometimes when he is on vacation, another lawyer from his office responds, but since this is a short vacation for him, you will probably have to wait.
