Anyone know of a lawyer in this country that handles Social Security Disability claimes?

I applied and just got my denial. They say I can work. Tehy also say that I have not had any doctors in this country to back up my claims. I don't have the money to go to doctors but I will if there is a good family doctor in my area that can look at my back and send me for a good blood test.

So what I needd is a lawyer here that can defend my denial and a local doc. near Zona Colonial that can write reports for my claims. Anyone can help I'd really appriciate. I don't know where to turn and I haven't much time left.

Are you talking about US Social Security or Dominican Social Security???

If it's US, you should get in touch with that agency at the US Consulate in Santo Domingo and file an appeal. They will describe the appelate process to you and the documentation necessary as an addeneda.

I have no knowledge of what you are up against but if I can be of any help here in the States, please let me know. I still have some very good friends that I knew when I worked for the gov.

Approximately 90% of people applying for SS Disability are denied on the preliminary application.

You will need a Doctor to certify that you are unable to perform ANY TYPE of remunerative work, not just your chosen field.

Figure going to an Administrative hearing where you will likely again be denied, but the third time before an Administrative Judge usually favors the claimant

I really don't know how the opinions of a non US Doctor will weigh, but I wouldn't be surprised if the SSA doesn't require you to be examined by a US Physician in the US

I don't know what your disability is, but unfortunately the people that seem to get approved the quickest are those claiming substance abuse or mental defect

Jan, we talked about this last time I saw you at Rocky's when you were chugging hot sauce and chasing it with Presidentes. I doubt whether SS Administration would accept the findings and opinions of a physician that is not licensed to practice in the States.

SSD hearings and appeals can get extremely complicated and you need somebody that concentrates their practice in that area. The tenor of KK's response about the difficulty factor is on target although I might disagree with some other aspects of KK's post. Obtaining SSD benefits is an extremely daunting endeavor. I don't touch those cases. I refer them out to others that have been successful in that arena as I'm not one of the good old boys in that arena.

Were you to prosecute an appeal I strongly recommend that you take the case to a practitioner that has had a great degree of success in SSD. There are people like that in Pennsylvania and you probably don't even need to travel up here for an appointment. Retainer agreement, medical authorizations and the like can be handled by fax, e-mail or worst case scenario, by Fed Ex. I do it all the time. There's probably better than a 50/50 chance that you would never be required to return here for any hearing on SSD.

If you get hit by a Budweiser truck call me. Otherwise, put the matter in the hands of somebody that has been successful in that specific arena. Any
schmuck lawyer in SDQ that's admitted to any state up here can file the appeal for you. The hard work comes after the filing. PM me with your e-mail address and I can probably get you turned in the right direction.

Even tho' I have x-ray and specialist proof of my condition the CPP people kept saying I could work - that the disability had to be "prolonged" and "severe". Good thing my DDD is degenerative so it only gets worse as time passes. Good thing when the nerves pinch and I lose the feeling in my feet,legs,hands or arms it's NOT severe .
I fought for over two and a half yrs and went all the way thru to the ombudsman........ so good luck! I couldn't even get my lousy $98. per month that I've paid into!
Too bad I wasn't on welfare before or I'd a qualified with NO PROBLEM!
Funny thing is 12 yrs and one heart attack later I'd have qualified after the heart attack if I had still been gainfully employed even tho' I'm in better health now than I've been for a long time......go figure!

Here's hoping you can dance with monkey 'til they play your tune - just don't count on a quick appeal!
