Default Drawing up association rules.

Fabio,

My wife and I wish you a happy, healthy, and prosperous new year.

We are in the preconstruction phase of a condo project and would like to put all our ducks in place before the condos are finished.

We would like to know what is the procedure to be followed to draw up a legal constitution, association rules, for condominians, (each condo will have a separate title)? Does this process have to be done by a lawyer?

I'm sure you will be able to locate some on-line. From my limited knowledge in the US value for the building/edifice is portioned off into valuation points based on the square footage per condo per no. of owner. So the larger your condo is the more you own of the building, assuming one owner per condo.

My best wishes to you and your family for 2005.

The condo procedure has to be done by a lawyer. Here's a summary of the legal steps which I posted some time ago:

1. The property should have a “deslinde”.

2. The plans for the condo building should have all the government approvals, up to the final approval at the Ministry of Public Works which issues a building license.

3. A petition must be submitted to the Superior Land Court with the following documents:
a) certificate of title to the property
b) complete set of approved plans
c) condo declaration containing description of the condo units
d) condo regulations

4. After reviewing the application, the Superior Land Court will issue a resolution ordering the Registrar of Titles of the jurisdiction where the property is located to cancel the old title and issue a new title for each condo unit.
