What is the procedure to separate a portion of land from a title shared among three owners? Present title clearly indicates the ownership of each by his percentage of the land, and separation is needed to obtain a new title for at least one owner.
You would have to go through a process called “subdivisión” which is somewhat similar to a “deslinde”.
The process requires the hiring of a licensed surveyor who will draw up a plan dividing the property among the three owners. This plan is then submitted to the Land Court together with the agreement between the parties as to how to divide the property. Once the agreement and the plan are approved, the Court will authorize the Registry of Titles to issue a new title to each owner, each with a different parcel number.
