possession of marijuana bail and process question
My friend's brother was charged with possession on the weekend in POP (from what I can understand not a large amount)--he is Dominican--long story short, he says someone else put it in his possession without his knowledge and set him up--is that true? I don't know--I was not there so I cannot say. That does not matter to me--what matters is his family--they are not in POP and are very worried about him and the fact that he is in jail or a holding cell or whatever it would be that he is in after initial arrest.
My question is this: what are the chances of him getting out on bail, approximately how much will it cost, and what is the process if he does get out on bail--if the family pays? Will he eventually go to court and then to jail--if so, for how long--is there a minimum?
Is there a site I can look at to see the procedure of it all? Thanks.

Highly unlikely he can get out, unless a large amount of money goes to the right people, and it wouldn't be for bail, IMHO.

he has a lawyer but I do not know if he is good--the lawyer is telling the family that he should be able to get him out on bail which is waving red flags at me (but maybe it shouldn't be).

There are whole jails full of people who said that. Also there have been many recent threads about Dominicans not taking blame or responsibility for what happens. "It's not my fault, someone else did it."

Putting drugs on somebody is an old custom by Dominican Police. Back in the 80's the police used to do it usually. I do not know if this has changed.
He needs a good lawyer who knows the system and where the right amount of money should be placed fast.
I know about cases where they put it in people car and motorcycle. It is very sad, but true.

it wasn't the police who did this but he believes a co-worker and, like I said, I do not know if this is true or if it happens often. I am worried about his family--they heard he may get 6 months up to 2 years in DR jail (is this accurate)?

Getting caught with marijuana is very serious in the DR. My dominican brother-in-law was arrested for that offense and he stayed in jail for about 4 months....no trial.

If your friend's brother WAS in possession - he has a problem.
If your friend's brother was PLANTED with the drugs - he has a similar problem as HE will have to PROVE the drugs were planted.
If the POLICE planted the drugs (not uncommon) - he has the same problem.
It is most unlikely he will be allowed out on bail even with a sizeable bail deposit. Find out from the family how long the preventina is for & check it's progress.
If the family &/or Friends start asking you for donations to the courts to get him out of jail, ................. YOU have problems! The emotional blackmail will be insistent & PERsistent - please do not give in to these emotional pleas! ~ Grahame.
