Default Police records and Cedulas

I was advised that my questions would be better suited under the legal forum, please assist if possible with the following questions...

1) How difficult (or not) is it for a Dominican to get their cedula if they have a police record?
2a) What are the repurcussions if you are stopped by the Police and you do not have a cedula? b)and you have a record?
3) If you retain an attorney, are they able to charge a fee for this "record" to go away in order for you to obtain the cedula? If yes, do you know how much this would cost?
4) If you are in the DR trying to change your life and you have a record/s in narcotics; can you be granted a pardon? What would you have to do to have your past stay in the past and not ruin your future plans etc..

Now if you try and get a job and that job requires a clean bill from the cops, that is not going to happen. At least in most cases.

While I would hope that the person you are referring to is able to go straight, the odds are against him/her.

It occurs to me on second reading that the person might not be a Dominican citizen. If this is the case, there is no way that the person will be able to get residence and a cédula.. Especially if the person has a record, and even worse if it is drug related....

NOW, if the person is a Dominican, they HAVE to give him a cédula....as long as he ca prove his Dominican citizenship by birth or parents.///

Hillbilly, you have hit the nail right on the head. TY BTW, he is a Dominican citizen. So, what's this story I hear about the police asking for cedualt and if you don't have one you are in big trouble ( I have heard this from a few Dominicans) The cedula is an ID right or do I have this mixed up. Does cedula = SIN and Identity card = State ID... Something along those lines.

Something is not right here. Everyone has a cedula from the time they are 16...fact of life here...
If not, they can get one with their birth certificate. FREE.

There are, as any legal beagle will tell you, a few caveats here. (1) Is a very late declaration of birth. Say your parents did not tell anyone you were born until you were 15. Then the case has to be investigated.
(2) Nobody has declared you as born. More paper work.
(3) You are a Haitian born in the DR to parents who were not Legally in the DR. More problems.

As you can see there are instances that can cause problems.

From what I seem to understand, Dominicans who get into trouble for not having a cedula are those who are less than 16 years old (and thus have none) and picked up by the police at four in the morning with a bottle of booze or at the wrong place all together. The cedula question is in these cases asked to tell the kids apart from the young men.

I see... I guess there is a whole lot to learn about how things work in DR. Maybe I should have asked here first before offering.... Ah well, I've already offered my help and a promise is a promise. Thank you for all your help.
