Legal Problem in Santiago
This is a good one. Where to start. Just got off the phone with the sister of a friend of mine who died in Santiago 3 weeks ago. The friend was a 37 year old woman who has been married to an Italian for 17 years. She has a 19 year old daughter i believe the Italian adopted when they married. She and the daughter have lived in a nice 3 bedroom paid for appartment in the Hace area for years. She bought a new Toyota Camery in May for cash so everything she has is paid in full.
Now this is the stickey part: she had a baby girl with a Dominican taxi driver last January that she has been concealing from the older Italian husband that works in Shangai. I have no idea how she pulled it off but the husband finally found out today when the 19 year old had to tell him because of this next part.
The Dominican went to the fiscal today and got an order saying that tommorrow he will come to the appartment for all the possessions and the new car. He came today with the police informing the 19 year old daughter of the impending action. Now they want to go and hide all the stuff tonight. And to top it off i believe the order also states the appartment is to be sold and proceeds split between the two surviving daughters. The taxi driver was a leach and never paid a peso for anything. But the rest of the family is broke and the Italian ****ed at the deceit so the 19 year old is messed up and ready to grab the 1st lawyer she can find. And yes, nothing was in the Italians name. Only the dead womans name. Italian does not have residency.
Trying to produce all the facts but it is confusing and i have known them for 4 years. I would apprieciate constructive advice and or assistance. Especially if Senior Guzman happens to be reading the board today.

It sounds rather complex, but it would be good to hide all the movable assets until things get worked out.
Otherwise, if they just come and grab them, you'll never see them again, IMHO.

They have a moving party set up for tonight but the 19 year old is afraid the fiscal will lock her up when he comes and nothing is at the appartment. I advised her to pack all the baby stuff and drop it off at his house tonight to show good faith and hopefully make him think they will comply. But there is a need for a good lawyer ASAP. I looked to see if Senior Guzman has an office in Santiago but i believe in the past i have read he does not. I also remember others saying they had good lawyers in Santiago but i can not find any referrence. Problem is the dead woman had all the money and no one can get it from the bank yet. Not toomany lawyers i am sure will take a case like this with no money down.

Jumbo call this number (809) 471-7747 her name is Lic. De LaRocha and is one of the top Lawyer in Santiago, she has worked a lot of high profile cases in the Cibao area.

If an order has been handed to her seizing the assets, forbidding her to move them, then she's correct, so she will have to go into hiding as well.
Otherwise, she can do as she pleases.
Possession is 9/10 of the law.

Thanks Tallman, left name and # on my friends voice mail. I guess the move has started since no one picked up. This is gonna be one ugly battle between two large Santiago families. In the end the lawyer fees will eat up all that is being fought for.

Interesting, but seen same case before!!!
This is not an unusual thing in the DR. Happens many time in a year. I feel for the 19 y/o daughter, but she should have seen what was coming. She is "una Dominicana", financially supported by a extranjero over the years. You can't teach civility/respect in such a household. Does not matter what you drive or where you live. Keeping a child secret from her husband is "inexcusable". The only ones that will really make out in this case, are the attorneys (both sides), then the fiscal. Everyone else will eat dirt, baby, daughter and the Italian. So sad, indeed.

Unless Dr. Guzman says different, I'd say that nothing can be sold, no matter what.
the cuckold is always p1ssed off, so what? He can't touch a thing.
why should he? it is not in his name.
The property will have to be divided between the children, and if there is a real marriage certificate, then the Eyetalian will get half legally..

Thanks HB. That is what i thought from all i have read here in the past. I told her the babies daddy will get 25% when all is settled but also told the daughter to insist on it being put in a trust if there is such an animal in the DR. I think he is bummed out he has to go back to picking up people at the airport. Last week he wanted her visa and passport so his sister could go to Florida and work. What a dumba$$.
