Default Divorce U.K. Resident

Hello, My fiencee has been separated for almost a year from her husband... he will not consent to a divorce... and in the U.K. without consent it would take upto 5 years. 2 if he consented 5 if he does not.

I am A United States resident and we would like to get married. and not have to wait the 5 years. we don't have any legal grounds for her to move to the U.S. for her to stay here for the time needed to become resident and get a divorce that way...

I would like to know if it would be possible to get a divorce outside the U.K. and make it fast.

any help or information would be great... the divorce has to be able to hold up so we can get married and she can immigrate to the U.S. Thank You

She can get a fast divorce in the DR but both spouses have to agree and one of them has to travel to the DR.

yeah they have talked to the husband... but he is a moron... he won't do anything without his mothers permission... "he cant read or write so she reads everything for him"

they went to a lawyer in the U.K. and they said if he does not consent to it... they can hold her up for 5 years

My thought was, that if YOU talk to the man you may get additional information about your future wife.

he won't talk to me... lol won't come near me.. something to do with me being afraid of me because I am a nut case... lol...

he is afraid of me because I have served several tours over in Iraq while in the Marines... and served over in Afghanistan and still want to go back... so he says I am crazy lol...

Ok, is this a Dominican girl married to an English guy living in England? And they have seperated and she is now dating you?
Why doesn't she go and see a solicitor and start divorce proceedings against him?? I don't know anyone over here who has dragged a divorce out for 5 years. ( Not even Sir Paul McCartney!)
Or she can divorce him on a two year seperation divorce. She will have to state the date they split and where she has lived since leaving him. Proving she has been apart from him for two years and does not intend to go back. (She's already 1 year into the seperation, so not long to wait.) Or depending on the circumstances of the seperation they can be granted a quick divorce a good solicitor will advise her. Maybe this helps...

no she is English... married to a English guy...

It is 2 years separation with consent... if he does not agree to it.. which he said he wouldnt... it will be 5 years.

1 Adultery.

2

Unreasonable behaviour of the other party eg violence, excessive drinking, neglect, making excessive sexual demands, associating intimately with another man or woman (short of adultery), keeping the other party unreasonably short of money.


3 Living apart for two years and the other party consents to the divorce.

4 Living apart for five years (consent of other party not required).

Desertion by the other party for two years. Undefended divorces are heard and pronounced in the divorce County Court in what is essentially an administrative procedure. The parties do not have to attend court. Defended divorces are rare and require a full hearing in open court. Financial provision and property adjustment orders can be made in connection with proceedings for divorce.

As you are posting on a site for all things related to the Dominican Republic, what is the connection with the DR? You having an English girlfriend married to an English man and you're maybe a Dominican man in the USA??

I think the OP is posting here as the law in the Dominican Republic enables people to get a quick divorce, regardless of whether they are Dominican citizens or not. However, quick divorces can only be granted with mutual consent which doesn't help the OP.
