Default Getting married after being 60 years old

I recently read that in the Dominican Republic if enter into marriage and you are 60 years of age or older at the time of marriage that you cannot divorce. Is this true?

It didn't sound right to me either but it was published in a magazine for corporations and individuals wanting to do business in the DR. It was compiled by a Dominican law firm but I don't remember the name.

I believe you read wrong. Probably you are referring to one of the guides by Pellerano & Herrera or Russin, Vecchi & Heredia Bonetti.

Maybe you could find the precise statement you are referring to, and post it here.

This is anecdotal, but I know of someone who married in the Dom Rep at the age of 64 and who has since divorced. Based on that, I would think that what you heard was incorrect.

Dolores, thank you for your help. Here is what I read and it is for divorce by mutual consent.
a) Divorce by Mutual Consent
This type of divorce may only take place after two years of marriage and before
30. Furthermore, the husband should not be older than 60 years nor the wife
older than 50 years.

This applies just for couples who plan to divorce by mutual consent. It cannot be done if the husband is 60 or older and the wife is 50 or older (Art. 27 of the Divorce Statute).

They can still divorce on other grounds. The standard one is incompatibility.
