Soy madre de un niño de 5 años, su padre vive en España, y yo actualmente vivo en England, antes de salir de Santo Dgo, hable con el padre via telefono y y quedamos de acuerdo que el se llevaria a mi hijo hacia españa, hasta que yo puediara tenerlo por los papeles, le firmo un documento por via de un abogado notoria, asediendo el permiso de mi hijo vivir con el.

hable con el hoy y me dice que ira a buscarlo en Octubre, que todo los documentos estan listo y no necesita mi firma para nada. ok
Tambien me dice que mi hijo vivira con el y solo el lo tendra, para vivir, osea el me lo enviara en algunas vacaciones.
Lamentablemente toso lo que hablamos en acuerdo sobre el niño, de que vivira con el por un tiempo, no esta escrito, y ahora el cambia de opinion.
Que puedo hacer en este caso, legalmente.

Espero que pueda ayudarme con esta inquietud.

I have no legal advice but I am sure that it will be coming soon...How has he changed his mind? Does he want to keep your son for good now? Any type of agreement such as that involving your children...ALWAYS,ALWAYS,ALWAYS get it in writing and have the other parent sign it and notarize it.

People can always change their minds and you want to make sure that what you agreed to will stay that way...

No legal expert but if the child is with you in England suggest you speak to an English lawyer (solicitor) familiar with international law. Maybe start with Citizens Advice Bureau to discover such a lawyer. Is care & custody of the child part of the divorce agreement? And if so, where was divorce granted i.e. which country? DR or UK?

Dr. Guzman will advise if it was a DR divorce, but if it was elsewhere I think you'll need a lawyer familiar with the law of that country.

El padre de mi hijo vive en españa y mi hijo en Santo Domingo, la cual cuando hable con el padre el dice que ya el tiene la tarjeta española para el niño y que lo buscara a finales del año escolar, pero yo solo le firme antes de viajar a England un poder de permiso, no he vuelto a firmar mas nada, incluso El dice que no necesito firmar documento de migracion.

Pero mi problema es que el acuerdo lo hicimos hablado, no escrito, en este quedamos que el niño vivira con el padre hasta que yo pueda conseguir los documentos o sea mi residencia, la cual es a finales del 2009.

ahora esta persona ha cambiado de opinion y dice que el niño vivira con el y solo me lo mandara de vacaciones osea por tres meses, algo que yo no deseo, porque yo deseo estar con mi hijo.

Que puedo hacer es esta situacion.

Ah! OK since your son is in Santo Domingo & not UK I think you need to wait for Dr. Guzman, the legal expert, to respond to this. He will tell you whether it is possible for the father to come from Spain and take the child out of SD to Spain without a signature from you. I had heard that if a minor is travelling with one parent out of DR then a letter of consent by the other parent was required, but Dr. Guzman is the person to give you the exact information.

nightrider, I'm certainly not Dr. Guzman nor am I a lawyer but your child's father can NOT legally transport the child without your explicit written, notarize and legalize consent.

Ley 136-03 para la protección de Niños, Niñas y Adolescentes:

Art. 110.- DEL TRASLADO O RETENCIÓN ILEGAL DEL NIÑO, NIÑA O ADOLESCENTE. Cuando una persona, más allá de los derechos que le hayan sido reconocidos, retenga a un niño, niña o adolescente, o lo traslade a un lugar o país diferente del que tenga su residencia habitual, sin la debida autorización, será considerado como traslado o retención ilegal de niño, niña o adolescente. El Ministerio Público de Niños, Niñas y Adolescentes deberá restituir al niño, niña o adolescente a la persona que legalmente tiene la guarda. Si el traslado hubiere sido a otro país, deberá dar los pasos correspondientes para reclamar su devolución ante las autoridades del mismo.


Art. 204.- ACOMPAÑAMIENTO OBLIGATORIO. Ningún niño, niña o adolescente podrá viajar fuera del país si no es en compañía de su padre, madre o responsable. Cuando viaje con personas que no son su padre, madre o responsable, será necesario la presentación de una autorización debidamente legalizada por un Notario Público. En ausencia del padre o de la madre, aquel que tuviere la guarda presentará una certificación del Tribunal de Niños, Niñas o Adolescentes, donde se haga constar la misma.

Párrafo.- Si uno de los padres va a salir del país con uno de sus hijos o hijas, no podrá hacerlo sin el consentimiento por escrito del otro.


Art. 405.- SANCIÓN POR RETENCION Y TRASLADO ILÍCITO. Padre, madre, responsables o terceros, autor o cómplice del traslado o retención ilegal en los términos establecidos en el artículo 110 de este Código, será sancionado con privación de libertad de seis (6) meses a un (1) año y con el pago de una multa de uno (1) a diez (10) salario mínimo establecido oficialmente, vigente al momento de cometer la infracción.

Párrafo.- En caso de reincidencia la sanción será de uno (1) a dos (2) años de privación de libertad y multa de diez (10) salario mínimo establecido oficialmente, vigente al momento de cometer la infracción.


Art. 406.- SANCIÓN POR EL TRASLADO ILÍCITO DE NIÑO, NIÑA O ADOLESCENTE AL EXTRANJERO. Quien promueva o preste ayuda, auxilio o sea cómplice en el traslado de un niño, niña o adolescente al extranjero, con fines de lucro, u otros fines ilícitos, en violación a las disposiciones legales, será castigado con pena de cuatro (4) a seis (6) años y una multa de diez (10) a treinta (30) salario mínimo establecido oficialmente, vigente al momento de cometer la infracción.

NotLurking is correct. The child cannot travel without your consent or a court order. If you gave your consent previously for the child to travel, it can be revoked. You should clarify who has custody of the child, whether you are divorced from the child's father or never married him, etc.

Many thanks for all replies,the father of my son say he now have yellow card,can someone tell me of this card?, also at time lawyer made document for me as to father taking son from Dominican Republic which I signed, but lawyer not add access for me to see son,can this document be changed to stop process before he leave country.
Your help would be much appreciated.

Fabio,thankyou for reply,I never married the father of my son as to custody, I have custody of son,at moment my mother care and look after him and we send money as well for support,hopefully to change document process all I need to know is how.
