Default Child Custody Question

My brother married a Dominican woman and has a child with her. They are divorced now and my brother (a foreigner) was granted 50% custody of the child, but the mother and her family have not allowed him to have the child reside with him at all and hardly even see him. A local judge has said that she may revoke the court order. Can that be done?

My brother also thinks that his baby is being abused physically by grandparents and mother, beaten with a stick because he cries (he's about two and a half year old), the grandpa certainly threatened him with a stick while the father was there). My brother lives in Samaná 6-8 months of a year, has a home there and has hired a housekeeper and a nanny to help with the child.

Does anybody have any experience on similar situations or any advice?
I'm very concerned.

Get a lawyer! Have the father take the divorce decree to a lawyer and have the lawyer go to court and have the judge force the mother to allow the 50% custody. this happens a lot as the family is probably looking for more money from the guy....who should have know better...And he can sue for full custody alleging child abuse by
the parent and grandparents.

You should hired a lawyer and go to court to enforce your visitation rights, it can be done even if you are foreign.

My father won a court battler against this lady he was dating, they had a daughter together, but that lady became a drunker and was not taking care my sister the way she should, so my father hired a law and even that lady family were in favor of my father, they all went to court (Her father, mother, brothers and sister) and testified against her. My father won full custody.

About the child being beaten, i don't think we consider that fisical abuse here. My grandmother used to beat up me too, my uncles, my aunts, my mother, it's just the Dominican way of life. All my friends were beaten too :-).

Thank you both for your replies.

I will convey this information to my brother so he can act upon it. I also think he needs a good lawyer. Yes, my brother should've known better but there's nothing worse than an old fool in love...with himself and the pride of being able to become a father at an advanced age.

This thing about corporal punishment has been bothering me personally a lot. This type of punishment os prohibited by law in my country (in Sweden) and the very idea of a toddler being beaten because he cries is an abomination. I don't agree with my brother a lot but I can see why he was upset.
