basically Extreme been not wrong,
if something is prohibited by law and many do not follow that law and break it does not mean that you are allowed to brake it, too, at the moment somebody complains about your braking of the law the authorities will come in and follow their procedure, of course in case of a gringo the fines appear on first side often higher than they would show up for the native neighbour as long as the gringo does not complain about exactly that. all those fine for breaking the law are defined in the law, you can read about them to find out what find come's up for breaking which law.
i do not know how big/wide a stream/river has to be to be named as such, but i know by own experience with a finca that water sources have to be accessible for the community, so those spots can not be fenced in a way where the community or the animals of the community have no further access to that water. in my case the solution been a gate which is not locked so when the smaller neighbours water sources run dry they can let in their cattle to access that water. i did not receive a complaint by neighbours/authorities or such, when i started to fence the area i talked to the neighbours about the plans, heck, they did more of the job and free of charge than i did myself, so overtalking all been the way i found out what is usual and to fence the area finally costed me the material and a few drinks.
in Grancas case where the Medio Ambiente been there visiting i would just recomment to ask exactly those guys from medio ambiente about the written complaint and their "order" to do something, because such, if going the legal way and not just some "primo/hermano/vecino/i know somebody" way, should state the 'violation' very clear including the number of law violated. so Granca can read exactly that law online and see who is right or wrong.
that half of the community is doing constructions/fencings aso illegally does not prevent anybody from any fine or knock down of his house in case of such official action just because the others also do it.
and i guess nobody wanna go in a war with the whole neighbourhood/community around?
would not be a good idea.

The applicable law is Law #5852 of 1962 (Ley sobre Dominio de Aguas Terrestres y Distribución Aguas Públicas), amended.

I don't understand why it does not open. I tried yesterday's link too and it won't even find the domain. But then, I still had it in my history, and low and behold, it does open... duh!
I saved a copy and will gladly send it out to whom ever wants it although the link above (in this post) seems for what ever reason to work.
Final update... I found the mistake on the first link... "http" appears twice in a row... a copy and paste mistake of my part. Sorry.

Latest update on this worry. Next door neighbour popped in to see us today, he told us that the Pueblo had decided that el Jefe of the Junta de Vecinos was and is loco so he has been sacked by the village. The new Jefe is a friend of our neighbour, the message is if we don't do anything they won't either and they don't think the Medio Ambiente will do anything. Let sleeping dogs lie. I like this place! I just wish they didn't play their music so loud!
