Default F1 student visa

Hi Everyone,

I want my husband to apply for a student visa to sudy english in the usa using an I-20 form giving by a USA university. However since he is waiting for an interview for his CR1 visa will they deny him because of this?

Please help

How long has it been since they put him on the list?

His case was completed in september of this year. But it is still the NVC awaiting an interview date.

I'm sure Tim can answer this better than I can but if you already have one petition on the go I don't think he can apply for a student visa.

If one could then all the spouses would go that route to cut down on the time it takes to immigrate to the US.

If he has a spousal petition pending, his chances of getting a student visa are slim to none. Even if he didn't, it's not as easy as you think. the tuition must be in the bank and they want to see that it accumulated over time, not all at once.
