Default k1 fiance visa

i sent papers for my petition on dec 30th 09, received aproval on april 9th. on april 16 i recieved my case #and all the next steps are written on the paper.they were to send my fiance all the info they said she needed in the mail. that is a joke, i told them i highly dout she gets anything in the mail. well for sure she didnt.so now i can call the consulate on the 16th tomorrow and they give her instructions to go to the consulate and pick up the package of instructions she needs. we have an interview on july 1st. so she has 2 weeks to get all the info that they want.one month ago would of been nicer , but we all know how things work there. i was told by a lawyer there that she could get aproved in 10-12 moths. so we shall see

Hi Kathy,

Please see the link here USCIS Home Page

You need to read the next steps under the K1 Visa..You are going to need 2 I-485 those are reports about your information etc. My advise is not to hire a lawyer as well, not needed! Just follow the link posted and read all about the forms you need. I think you will also need to file a I-130. If you filed the I-129F, you will definitely need to file the I-130. All together your looking at about 1,000 US dollars for all forms to be filed. You can also track the status of your K-1 Visa through the website and contact the Vermont USCIS depending where you live. The Vermont should still be the correct location to call since 95% of the cases go through them, and they will help you with any questions you may have. I hope this post and the other post find you guys together soon!

Also, you should start to get things going in the right direction since most Embassy's think these marriages are bogus and only for money. You should start to keep any communication via email and print them out when you are interviewed. You should also make sure you know all of your future husbands family names, where they live, and most important, all information about him...favorite color, music, etc...You should get photo's taken of you and him and any of his family members out at picnics, any get togethers. This will make their decision easy and less thoughts about a bogus marriage. Most of all, if you don't live here, make sure you make some trips to see him! This way you will have proof on your passport that you came here many times because its true love and you missed each other. Now, depending on the time (6 Months- 1 Year) your future hubby is going to need a police report stating that he is not a criminal and has a clean record. He will also need to have a complete physical stating he is in good health. You should also obtain a letter of support and a letter from your job stating how long you been there and etc. You will need 2-3 years worth of your W-2's and of course your bank information. So, what I'm saying, make sure you have this ready because it takes time to get this done and I'm sure you don't want to waste time and hold up this process when its approved. lets discuss, If you need further help, please PM me

Good Luck!

Noel

Hi kathy,

Just something more to think about although you had already filed for the K-1...You should of did the K-3 since you would of been married already and it would be much faster. Call Vermont and see what they tell you for all of the correct facts!

Isn't the CR1 visa faster? One of our members posted this Permanent Residency to US took 1 1/2 months!

Hi Anna,

I think that is for a resident only. I wonder if they were married before, got approved for their Visa, than went for the permanent residency. I know all about the K-1 K-3...and the permanent residency would only be filed after 5 Years of living in the states after the green card has been completed. But then, you need to take a test and its not easy if you don't know about one's Country.. Strange stuff..lol I can only think its because that person had a residency here in the DR has well, that must be the difference. Do you have further information? Interesting...

Hi Anna C,

I was just reading that thread, still seems like some information is missing since the poster is making us think that they filed for this first. Can't be, they would have had to be married first from what i can tell, than file for the CR within the 2 Year period as per your post. I never heard of this...I hope its factual, but I will check into this anyway since I am waiting to file for my wife's K-3 as soon as I get up enough money to file, not to mention my missing birth certificate..lol good eh? ug!

I will post back to this thread in time when I start my case. This way I will have all of the facts, time, pro's and cons so you can make a sticky if you like.

The only way you can do the visa like I did (DCF), is if the US Citizen is also Permanent Resident of dr and have lived her for at least 6 months. I did it, and we picked up the visa last week! But, it only works for the special circumstances, but if you meet the requirements, it is the way to do it!

A Cr1 is the best visa to get because you do not have to change status. They are a Permanent Resident the second they get into the Us, with the condition that you stay married for two years. K3 costs 1100 dollars extra to pay to change the status....waste of money!
