Default Dominican to UK

Hi,
Just wondered if someone could explain this to me as I feel like i dont understand this process very clearly.

I have lived in DR for 2 years with my Dominican boyfriend and we have a child together (we own no property here) And I would like us to move back to UK next summer. SO here is the question...

If we got married here, would we apply for a spouse visa and he would get it no problems because we are married? Or do we still have to prove our relationship etc

I need an idea of how much this is likely to cost and how likely it is for him to get the visa.

As you know there are two different types of visa - one a visitor one and one for permanent residency. For the first your husband would have to prove he will come back here - so he needs money in the bank, to own property or a business here, and basically a reason to come back. For example if the two of you, plus child were going to UK for a holiday, say for a wedding, you would just need to provide proof that you were going plus proof that you were both coming back - ie letters from employers to say you were on holiday, title deeds from house, bank details etc.

However, if you both want to go back to Uk permanently then it is totally different. You have to prove that you will support him. You would need a job and a house or flat in UK as he is not allowed to work when he arrives for 3 months I think it is. It does not matter what he has here as they know he will not come back. So in these cases you will need to go back to Uk alone, get a good job, find accommodation, and in 6 months time prove to the Visa people that you have money in the bank and you can support him, then you can apply for a visa. If you are thinking of living on benefits when you go back then in my experience you can forget it.

I know of several examples where the British lady has a good job and she has had no problem getting her husband to England. Another couple in your situation - ie were both living here, she has gone back and is working and sorting out accommodation. Once she has been there 6 months and has everything sorted and some money in the bank then he will apply. When you apply you will have to prove that you married for love and not an arranged marriage for a visa. So wedding photos, etc etc.

I would think the only way round this is to prove that you do not need to work as, say, your parents are very rich and they will pay for you both to live!!!

Ok, that makes more sense to me.

If I have a job and place to live, then he will get the visa no problems?

I had a friend who was married to a Dominican and lived here a few years then they both moved to UK together. She didnt have to go home first, they both got the visa and flew together. She didnt have a job waiting either.

I would be going back to live with my parents for a while so thats one thing sorted, just need to prove we will have money.

How long is the visa process about?

No one here can say if he will get a settlement visa, no problem. Check the link for wait times but don't count on it 100%

they do have a common law type visa as well.

i dont know how to qualify other than you do have to live continuously together for 2 years.

Clare things have changed over the years
i had no job when i got my wife here
she did not have to do the E S O L test
when you get married he is not allowed to work
i think it is for 6 months
and no resources to the public funds
btw i got my wife here on a fieancé visa 7 years ago
it only took a few months then

the new visa application is on line. It takes around 2 weeks. Be aware that all decisions are now made in new York and the local embassy here has no say in the matter. You apply and pay on line. You then make an appointment on line to deliver your supporting paperwork to the embassy. You are then informed of the outcome. I do not know the statistics but from what I can tell having helped dozens of people over the last 9 years or so it is certainly getting somewhat more difficult.
