Default Open Work Permit..re Immigration Canada

Hi. I was just wondering if any of you waiting for a PR Visa, have applied for a Open Work Permit for your spouse. I have talked to a lawyer (not hired a lawyer - as I know that won't help - just to squash the post going that way) and she has said that if I don't hear anything in 6 more months to go that route. She says because I have already been approved as a sponsor that this will not be declined.

Has anybody gone through this?

This is for Canada right? I have never heard of this. It will be interesting to hear what the more experience people have to say....

As you may have read in other posts it is difficult for Dominicans to get any type of temporary visa to Canada. Hope the information below might help you decide if you want to go through the processes of applying for a work permit, finding an employer to provide an offer to work and the employer must receive a 'positive' Labour Market Opinion from Human Resources Canada.

Dual Intent refers to the concurrent processing of an application for Permanent Residence and an application for Temporary Status, therefore demonstrating the intention to both reside in Canada permanently and only temporarily, at the same time.

Although this may appear contradictory at first glance, in fact it is possible. Imagine, for example, the following scenario:

An individual submits an application for a Canada Immigration Visa. Before receiving the Canada Immigration Visa, the individual wishes to visit Canada for a short time and applies for a Temporary Resident Visa (TRV), or appears at the Port of Entry, if a national of a TRV exempt country. This is perfectly acceptable as long as the individual intends to leave Canada at the end of the visit.

The same principle applies to individuals who are in the process of applying for a Canada Immigration Visa and wish to obtain a temporary Work Permit or Study Permit.

An individual whose application for Permanent Residence in Canada is pending is subject to the same requirements as others when seeking entry into Canada temporarily. The individual should therefore have a reasonable purpose for entry, be prepared to leave Canada at the end of the temporary stay and understand that if a Canada Immigration Visa is issued, he or she must leave and re-enter Canada in order to officially land as a Permanent Resident.

An application for Temporary Status may be scrutinized more closely when a Permanent Resident application is under review, as there is an obvious intention to settle in Canada permanently. If the individual’s ties elsewhere can be demonstrated, however, an application for Temporary Status should succeed.

apparently an open work visa is different as you don't need a sponsor??? I don't know ... everybody says different things. I'm going to call CIC tomorrow and will post information.

I've found some information but not enough to be clear. I was busy all day at work tho and the kids are monopolizing my time tonight, so maybe tomorrow I'll have more time to investigate. I will definately call tho.

I have a feeling that although you may technically be allowed to apply for 2 types of visas at one time, they will never approve it. Just like a visitor visa they will take your $$$ and your application and instantly deny the applicant.

It may be possible for citizens of other countries who aren't as likely to disappear in the night once they arrive.

Please post whatever info you find because this is new for everyone.

Hi ... talked to CIC. Open Work Permits are permits for spouses sponsoring their spouses and are available only to in-country applicants. Whatever?!??!?! ARGH!!

A visitor visa is not looked at differently due to the original application ... but I'm still going to try. Its only 75 dollars.
