Please help...i bought land and dont know its location
A brief background
i bought land before the deslinde law process was enacted
i was shown a block by the sales person and bought it.
title has been cleared 3 times by my lawyer over the course of 2 years or so....an excellent lawyer of high standing in the foriegner community
my titulo makes reference to the area my land is in X ref xx.it does not say the block number. which my lawyer says is not uncommon
i began my deslinde process and by chance i went into a real estate business on the north coast and the owner said she owned the block i was shown. she had the entire plan for the whole area with block numbers etc listed for these land blocks.
i went back to the seller i.e the actual owner...and to cut a long story short over the last 10 or 12mths he REFUSES to make himself available to show me the block i actually bought. he admits the block i was shown was not the correct block to my lawyer
he wants to give me my money back, which i dont believe.
my land of 987m2 is located within a 8000m2 block of land we think, although this is now open to speculation.
i have a surveyor of peurto plata working for me and is trying very hard to locate this land via all the means at his disposal...i.e contacts at the land court
my lawyer basically said because the seller has not shown me the actual location there is NO other way to discover the location of the land.
however this seller could tell me more lies, how do i know if hes telling me the truth if he eventually does make himself available
i have had enough and have made contact with his family member threatening legal actionñ he is out of the country at present
i am a resident of the DR
someone please help if this seller wont show me my land which is located in a huge block of land then who can
can the surveyor do this, even he has shaken his head and said mucha problema....mafiosos!
my lawyer has referred me onto criminal lawyers
which i will absolutely use to suck every last cent out of the seller even if it costs him his house to mount a legal defence
Please if there is another way to find my land so i can deslinde it please tell me. as the surveyor may be in trouble because he has deslinded the wrong land . i have paid 3 parts of the deslinde to date so the surveyor has made record of my property location ...which belongs to someone else. Now he is in trouble, he said..legally speaking!!!!!!!!!!!!!!!

if you have more questions please ask...i will keep the location private. it is on the north coast though

If you already have a really good lawyer and surveyor, I don't see a whole lot else that you can do.

Well respected?
You don't want to be asking this on an Internet forum, you want to take the original "well respected" lawyer by the neck and demand to know whats what

Without a survey your title is worthless.

This sounds just like some of those events that used to go down at Chiquito a few years back. Shouldn't your lawyer (conveyancing lawyer, not the criminal one) have done searches at the time of purchase?

my lawyer claims to have done searches and the title is clear...we simply need the location of the land and the seller refuses to make himself available to show us!
my lawyer says i own land and i have the parcel numer X-ref-XX and that corresponds with the map i have of the land in question which is X-ref-xx so we (lawyer and me) know that the land is in the passel of 8-9000 mtr2.............but actually WHERE???? god knows. There are at least 20 different blocks
i have all of the titles held by the previous owner to the one i bought from showing transference of titulo..............i just dont know its location
so are you telling me that
because i was shown land
agreed to pay for it
received a clean title
was later told that its not my land
cannot locate my land bought because of the slow to present himself seller
that the titulo is worthless
and that the only means of locating this lands location is by the seller and that there is no other OFFICIAL means to confirm the location of this land, and thus i have to TRUST this person who has proven himself to me to be a person of 'no repute"
Please if you know of what i can do...please help
no its not in chiquito

Are there any legal demands i can make??
has this seller broken any laws?
Is he legally bound to show the land?
what can i do????
Mr Guzman, ive used your services before and have been very impressed , i just got my residency with one of your Santo Dom lawyers..........fantastic. Their assistance was always 'prompt and factual'
please help me if you can

This probably didn't occur to you... track down the previous owner (not the one you bought it from, but the one before) and ask him a favor to show you the land - he should know where the lot is located

That would be a good idea if the previous owner knows that information; certainly worth trying. I'm wondering if the seller that rocker67 bought from doesn't actually know, which might account for his reluctance to make himself available: rather than admitting he doesn't know, he is not coming forward. How about asking whoever assigned lot reference numbers in the first place?
